Terms & Conditions

1. Definitions

In these conditions the following expressions shall have the following meanings.

1.1."The Company"

Shall mean Fourdot Affinity Ltd (parent company of Luminati) and also where the content so permits any subcontractor for the said company. The companies details are as follows:

1.2."Goods"

Shall mean the article or thing or any of them described in the contract between the company or the buyer for the sale or supply of goods.

1.3."The Buyer"

Shall mean the person, firm or company with whom any contract to sell goods is made by the Company whether directly or indirectly through an agent or factor who is acting for or instructed by any such person firm or company of whose actions are subsequently to the contract ratified by the actual buyer.

1.4."Company's Premises"

Shall mean the premises mentioned in the Company’s quotation or other contractual document or if not so mentioned shall mean the Company’s works at The Display Works, East Way, Lee Mill Industrial Estate, Ivybridge, Devon, PL21 9GE.

2. General

These conditions shall be deemed to be incorporated in all contracts of the Company to sell goods and in the case of any inconsistency with any letter or quotation incorporating or referring to these conditions or any order letter or form of contract sent by the Buyer to the Company or any other communication between the Buyer and the Company whatever may be their respective dates the provisions of these conditions shall prevail unless expressly varied in writing and signed by a partner in the Company. Any concession made or latitude allowed by the Company to the Buyer shall not affect the strict rights of the Company under the contract. If in any particular case any of these conditions shall be held to be invalid or shall not apply to the contract the other conditions shall continue in full force and affect.

3. Orders

3.1 Notwithstanding that the Company may have given a detailed quotation no order shall be binding on the Company unless and until it has been acknowledged in writing by the Company.

3.2 The Company’s catalogues, brochures, leaflets or correspondences are not binding as reasonable variations may be made without notice and such Goods as varied shall be accepted as complying with the contract.

3.3 All customer orders need to be processed by the Fourdot Affinity office prior to acceptance as a purchase order. Processing is usually completed within 24 hours of the order being received (excluding weekends).

4. Prices

4.1 The price payable for Goods shall unless otherwise stated by the Company in writing and agreed on its behalf be the price of the Company current at the date of dispatch and in the case of any order for delivery by instalments the price payable for each instalment shall be the list price of the Company current at the date of dispatch of such instalment unless otherwise stated to be firm for a period.

4.2 Unless otherwise expressly slated to be firm for a period the Company’s prices are subject to variation to take account of variations in wages, materials or other costs since the date of the order. The company accordingly reserves the right to adjust the invoice price by the amount of any increase or decrease in such costs after the price is quoted and the invoice so adjusted shall be payable as if it were the original contract price.

4.3 All prices are exclusive of Value Added Tax and this will be charged at the appropriate rate.

4.4 The company reserve the right to increase/decrease costs to the buyer after the order has been confirmed up until the point of despatch if unexpected charges apply. 

5. Additional Costs

5.1 The buyer agrees to pay for any loss or extra cost incurred by the Company through the Buyer’s instructions or lack of instructions or through failure or delay in taking delivery or through any act or default on the part of the Buyer its servants, agents or employees.

5.2 Orders delivered outside of the UK may be subject to local import duties.

5.3 Additional delivery charges may apply if a dedicated/specialist courier service is required.

6. Patents

The Buyer shall indemnify the Company against all costs claims and damages incurred or threatened arising out of any alleged infringement of patents trademarks or copyright occasioned by the manufacture or sale of the Goods made to the specification or special requirements of the Buyer.

7. Payment

7.1 Payment is required in full for all orders placed online at the time of the order being placed unless the option of payment by cheque or bank transfer has been selected in which case the order cannot be processed until full payment has been received. A proforma invoice detailing our company details and the amount due will be emailed within 24 hours (excluding weekends).

7.2 If the Goods are delivered in instalments the Company shall be entitled to invoice each instalment as and when delivery thereof has been made and payment shall be due in respect of each instalments whereof delivery has been made not withstanding non-delivery of other instalments or other default on the part of the company

7.3 If upon the terms applicable to any order the price shall be payable by instalments or if the Buyer has agreed to take specified quantities of Goods at specified times a default by the Buyer of the payment of any due instalment or the failure to give delivery instructions in respect of any quantity of Goods outstanding shall cause the whole of the balance of the price to become due forthwith

7.4 The price of the goods shall be due in full to the Company in accordance with the terms of the contract and the Buyer shall not be entitled to exercise any set off lien or any other similar right or claim.

7.5 The time of payment shall be of the essence of the contract.

7.6 Without prejudice to any other rights it may have, the Company is entitled under HMRC guidelines to charge interest 8% above the current Base Rate of The Bank of England on overdue payments of Goods or the price of instalments thereof.

8. Delivery

8.1 The period for delivery shall be the period within which the Goods as intended to be despatched from the Company’s premises and shall be calculated from the time of the receipt by the Company of the Buyer’s offer or from the receipt of all necessary information to enable the Company to manufacture or procure the manufacture of the Goods whichever shall be the later and the Buyer shall take delivery of the Goods within that time. Only a non-guaranteed estimated despatch date can be given and any failure to deliver on the intended date is never grounds for cancellation or termination of an order, or a reason to withhold payment.

8.2 All times or dates given for delivery of the goods are given in good faith but without any responsibility on the part of the Company. Time of delivery shall not be of the essence of any contract nor shall the Company be under any liability for delay whether or not beyond the Company’s reasonable control unless otherwise expressly agreed in writing at or before the date of the order in which case the Company’s liability shall be limited to such liquidated damages as may specifically be agreed at or before that date

8.3 The contract is divisible.  Each delivery made hereunder: 
(a) Shall be deemed to arise from a separate contract, and
(b) Shall be invoiced separately and any invoice for a delivery shall be payable in full in accordance with the terms of payment provided for herein without reference to and notwithstanding any defect or default in the delivery of any other instalment.

8.4 Where the goods are handed to a carrier for carriage to the Buyer or to United Kingdom port for export any such carrier shall be deemed an agent of the Company and not the Buyer for the purposes of sections 44,45 and 46 of the Sale of Goods Act 1979.

8.5 No liability for non-delivery partial loss or damage to the goods occurring prior to delivery or for any claim that the Goods are not in accordance with the contract will attach to the Company unless claims to that effect are notified in writing by the Buyer to the Company (and in the case of claims for non-delivery partial loss or damage with a copy to the carrier if the Company’s own vehicles have not been used to deliver the goods)
(a) Within 24 hours of delivery for partial loss damage or non-compliance with the contract or
(b) Within 7 days of the date of invoice for non-delivery

8.6 In the event of a valid claim for non-delivery for partial loss damage or non-compliance with the contract the Company undertakes at its option either to reprocess or replace the goods at its expense but shall not be under any further or other liability to any person in connection with such non-delivery partial loss damage or non-compliance.

8.7 If the Buyer shall fail to give notice in accordance with condition 8 (4) above the Goods shall be deemed to be in all respects in accordance with the contract and the Buyer shall be bound to accept and pay for the same accordingly.

8.8 If for any reasons the Buyer is unable to accept delivery of the Goods at the time when the Goods are due and ready for delivery the Company may at its sole discretion without prejudice to its other rights store the Goods at the risk of the Buyer and take all reasonable steps to safeguard and insure them at the cost of the Buyer, provided that the Buyer shall be immediately informed thereof

8.9 The Buyer shall be obliged to accept delivery at any time before the contract is determined or instalment cancelled.

8.10 The Company shall have the right to make delivery by instalments of such quantities and at such intervals as it may decide and any express provision as to instalment in the contract shall be in addition to and not in derogation of this right.

8.11 The delivery charge quoted will be for a door to door service only. For an additional cost we are able to offer an extra service for larger items delivered where our courier will be happy to offer further assistance and remove any pallet(s) if required.

8.12 Our couriers frequently use heavy goods vehicles to make delivery. An additional charge may need to be applied to your order if a courier considers access to your delivery address to be limited to heavy goods vehicles.

8.13 Free delivery is only offered via the site and is automatically applied when the cart value exceeds £100 ex VAT. Free delivery is only offered on orders placed via the website (https://www.luminati.co.uk/) and for mainland UK only.

Delivery Instructions and Limitation of Liability

8.14 Special Requests Customers may submit requests for specific delivery instructions, including, but not limited to, desired delivery times or specific drop-off locations. While we will make reasonable efforts to accommodate these requests, it is ultimately at the discretion of our courier partners to comply with these instructions.

8.15 Limitation of Liability
We cannot be held liable for any failure by our courier partners to adhere to special delivery instructions submitted by customers. Once your order is in the hands of our courier partners, their own terms and conditions apply. Although our couriers are obligated to exercise due care in line with UK law during delivery, we are not responsible for any issues arising from special instructions that have not been followed, particularly if they are considered unreasonable or infeasible.

8.16 By using our service, you acknowledge and agree that the responsibility and liability for delivery logistics lie with our courier partners and that we are not liable for any failures or omissions on their part in relation to special delivery instructions.

9. Returns

9.1 Your items will be packed and shipped with the greatest care. If your items fail to arrive in good condition, you must contact us within 24 hours of receipt in order for us to arrange for a replacement to be sent.

9.2 In the event that goods have been received and the wrong component has been ordered or you are not happy with the products that you have received for any reason, you must call Fourdot Affinity within 14 days of receiving your order and we will assist. If you wish to return an item, we will provide you with an RMA number and you will be responsible for the costs of shipping the item back to us. Any goods returned must be received by us in the same resalable condition and, as far as possible, in the same packaging as when they were delivered to you. Credit/debit card refunds can only be refunded back onto the original card used to purchase the goods. BACs payments will be refunded by a cheque.

9.3 It is vital to obtain a proof of postage certificate when returning goods as we can’t be held responsible for goods lost in transit to us.

9.4 If for any reason goods are received faulty or the wrong item has been despatched, please contact our customer service team within 24 hours of receipt to inform them of the error Provided the team have been alerted within the required 24 hour period, the correct item ordered will be despatched at no extra cost as soon as possible.

9.5 Custom made products or standard products where branding has been added cannot be returned unless they are faulty or differ substantially from the item ordered. Any decision made will be at the discretion of Fourdot Affinity.

9.6 Fourdot Affinity are continuously updating and improving our product designs. We accept no liability for any slight changes or improvements that have been made to products detailed on our website.

9.7a No goods may be returned without an appropriate RMA number. This can be obtained by telephoning Fourdot Affinity Customer Services on 01752 698720 or e-mailing [email protected]

9.7b Returns will be subject to a 20% restocking fee charge.  Digital Screens will be subject to a 20% restocking fee.

9.8. If for any reason you wish to cancel your order, please review our cancellation terms in section 20. 

10. Carriage

Where the Buyer requests delivery prices quoted will be based on a full load, any shortfall resulting in difference in cost shall be charged to the Buyer’s account.

11. Passing Of The Title & Risk

11.1 From the time of delivery the Goods shall be at the risk of the Buyer who shall be solely responsible for their custody and maintenance as if it were the owner, but unless otherwise expressly agreed in writing the Goods shall remain the property of the Company until the payment due under the contract between the parties has been made in full and unconditionally or until resale of the Goods by the buyer bona fide in the ordinary course of its business and at full market price and the Buyer shall sell as principal only. Whilst the ownership of the Company continues the Buyer shall keep the Goods separate and identifiable from all other goods in its possession.

11.2 In the event of any resale by the Buyer of the Goods the beneficial entitlement of the Company shall attach to the proceeds of sale or other disposition thereof so that such proceeds or any claim therefore shall be assigned to the Company and until the subject to such assignment shall be held on trust for the Company by the Buyer who will stand in a strictly fiduciary capacity in respect thereof.

11.3 In the event of failure to pay the price in accordance with the contractual obligations the Company shall have the power to resell the Goods after reasonable notice such power being additional to (and not in substitution for) any other power of sale arising by operation of law or in implication or otherwise

11.4 Not later than the time of delivery of the Goods to the Buyer, the Buyer shall insure the Goods and keep the same insured while they remain the property of the Company against the loss or damage by accident, fire theft and other risk usually covered by insurance in the type of business for which the Goods are for the time being used. The Goods shall be insured to the full replacement value thereof with some insurance company to be approved by the Company under a comprehensive policy of insurance free from all restriction or excess in the name of the Buyer bearing an endorsement recording the Company’s interest and stating that no payment is to be made to the Buyer under the policy until the Company’s interest has been discharged and in default of the Buyer so doing the Company may insure as aforesaid and recover the cost from purpose of receiving monies payable under the said policy and giving a discharge therefore. The Buyer shall punctually pay all premiums payable under the said policy and produce the receipts for such payments to the Company on demand and shall do everything necessary to maintain the said policy in full effect and not do anything whereby the said policy will or may be violated.

12. Conditions & Warranties

12.1 Every description or specification of the Goods given in good faith based on average results of standard tests but any conditions or warranties express or implied that the Goods shall correspond with such description or specification are herby expressly negative and the use of any such description or specification shall not constitute a sale by description.

12.2 Any conditions or warranties (whether express or implied by statute common law or arising from conduct or a previous course of dealing or trade custom or usage) as to the quality or fitness of the goods for any particular purpose even if that purpose is made known expressly or by implication to the company and hereby expressly negative

12.3 Notwithstanding that a sample of the Goods may have been exhibited to and inspected by the Buyer or results of standard tests upon a sample furnished to the Buyer. It is hereby declared that sample was so exhibited and inspected or tested solely to enable the Buyer to judge for itself the quality of the bulk and not as to constitute a sale by sample. The Buyer shall take the Goods at its own risk as to their corresponding with the sample or as to their quality condition or sufficiency for any purpose.

13. Defective Goods

13.1 In substitution for all rights which the Buyer would or might have had but for these conditions the Company undertakes at its discretion to credit the Buyer in full the price paid by the buyer to the Company or repair or supply free of charge at the place of delivery specified by the Buyer for the original Goods a replacement of the Goods if manufactured or processed by the Company in which a serious defect in materials or workmanship appears within three months of delivery provided in any case the Goods have been accepted and paid for and were manufactured or processed by the Company.

13.2 In the case of Goods not of the Company’s manufacture the Company will pass on to the Buyer any benefits obtained under any warranty given by the Company’s supplier provided that the Goods have been accepted and paid for.

13.3 In order to exercise its right under this condition the buyer shall inform the Company within seven days of the date when such defect appeared or ought reasonably to have been discoverable and shall return the defect Goods carriage paid to the Company’s premises.

13.4 Nothing herein shall impose any liability upon the Company in respect of any defect in the Goods arising out of the acts omissions negligence or default of the Buyer its servants or agents including in particular but without prejudice to the generality of the foregoing any failure by the Buyer to comply with any recommendations of the Company as to storage and handling of the Goods. 

13.41 Special Note on Cleaning Acrylic Items: To clean acrylic items, use soapy water and a soft cloth. DO NOT USE cleaners containing alcohol or solvents, as this may cause the items to crack. Failure to follow this guidance is considered negligence on your part, and we assume no liability for any resulting damage.

13.5 Where the Goods are for delivery by installments any defect in an installment shall not be a ground for cancellation of the remainder of the installments and the Buyer shall be bound to accept delivery thereof.

13.6 It is imperative that the goods be thoroughly inspected prior to installation. Any damage, defects, or discrepancies with the goods must be identified and reported before the installation process begins. In the event that damage or any issues with the goods are discovered after the installation has taken place, Luminati will regrettably be unable to provide a refund or arrange for a replacement of the order.

13.7 Nothing herein shall have the effect of excluding or restricting the liability of the Company for death or personal injury resulting from its negligence.

14. Buyer's Drawings

The company shall not be liable for imperfect work caused by any inaccuracies in drawing, bills of quantities or specifications supplied by the Buyer.

15. Consequential Loss

The company shall not be liable for any costs claims or damages or expense arising out of any fortuitous act or omission or any breach of contract or statutory duty calculated by reference to profits income production or accruals of loss of such profits income production or accruals or by reference to accrual of such costs claims damages or expenses on a time basis.

16. Default or Insolvency of Buyer

If the buyer shall fail to accept the Goods or any instalment or part instalment thereof or shall fail to pay any sum due to the Company at the proper time or make default in or commit any breach of any other obligation or if any distress or execution shall be levied on the buyers property or assets or if the Buyer shall make or offer to make any arrangement or composition with his creditors or commit any act of bankruptcy or if any bankruptcy petition be presented against him or (if the Buyer is a Company) if any Resolution or Petition to wind up such Company shall be passed or presented or if a receiver of the whole or any part of such Company’s undertaking property or assets shall be appointed, the Company in its discretion and without prejudice to any other right or claim by notice in writing determine wholly or in part any and every contract between the Company and the Buyer or may (without prejudice to the Company’s right subsequently to determine the contract for the same cause should it so decide) by notice in writing suspend further deliveries of Goods until any defaults by the Buyer be remedied.

17. Limitation of Liability

The liability of the Company to the Buyer for any loss or damage of whatsoever nature and howsoever causes shall be limited to and in no circumstances shall exceed the sales value of the Goods

18. Representations

No statement description information warranty condition or recommendation contained in any catalogue price list advertisement or communication or made verbally by any of the agents of employees of the Company shall be constructed to enlarge vary or override in any way nay of these conditions.

19. Force Majeure

The Company shall be entitled to delay or cancel delivery, or to reduce the amount delivered if it is prevented from delivery, hindered in delivery or delayed in manufacturing.   Delays in delivering the Goods by normal route or means of delivery through any circumstances beyond our control including but not limited to; strikes, lock outs, accidents, war, fire, reduction in or availability of power at manufacturing plant, breakdown of plant or machinery or shortage or unavailability of raw materials from normal sources of supply.

20. Cancellation

Save as provided in conditions 16 and 19 hereof contracts may not be cancelled except by agreement in writing of both parties and upon payment to the Company of such amount as may be necessary to indemnify the Company against all loss resulting from the said cancellation.

Cancellation terms are product-specific and vary based on the type of item you’ve ordered. Please carefully review the different terms below: 

20.1. Standard In-Stock Units: Once a buyer has purchased a standard unit that is currently in stock, cancellations are not permitted if the order has been despatched. This policy is in place to ensure the swift processing and dispatch of the order. If the order has not been despatched, the goods can be cancelled and refunded, and a restocking fee may apply. If you wish to return your product, please review section 9 of the terms and conditions. 

20.2. Standard Units Out of Stock: If a buyer has purchased a standard unit that is currently out of stock, cancellations are allowed within 24 hours of placing the order. This provides flexibility for customers who may need to reconsider their purchase due to unforeseen circumstances. After the 24-hour window, the cancellation option will no longer be available and a restocking fee may apply.

20.3. Custom or Bespoke Units: For custom or bespoke units, if the design process has commenced, the buyer will be obligated to cover the associated design fee in the event of a cancellation. Once an order has progressed to the manufacturing stage, cancellations are not possible. We encourage buyers to carefully review and confirm their custom unit specifications before moving forward with the purchase.

21. Sub-Contracting

The Company may assign the contract with the buyer or sub-contract the whole or any part thereof to any person firm or Company.

22. Headings

The headings in these conditions are intended for reference only and shall not affect their construction.

23. Proper Law

The contract shall in all respects be governed by English Law and shall be deemed to have been made in England and the Buyer and the Company agree to submit to the non-exclusive jurisdiction of the English Courts.

Digital Screen Warranty Information

  • Covers hardware failure but excludes accidental damage or user error.
  • Free lifetime telephone and email technical support.
  • 14 day returns policy.
  • All standard product ranges come with a 3 year warranty starting from date of invoice. This excludes all products purchased before 18/01/2016, which came with a 1 year warranty period.
  • Any suspected hardware failure should be reported to LUMINATI first. LUMINATI will then provide telephone and/or email technical support to determine hardware failure; hardware failure must be confirmed by LUMINATI.
  • All screen sizes up to and including 55”, as well as media players, are covered by a swap-out or collect and return service. Screens larger than 55” and freestanding models (L and OT ranges) are covered by an on-site service.
  • Once hardware failure has been determined by LUMINATI over the phone or on email the screen should be repackaged using the original packaging material and method (including bespoke pallet where necessary). At this point LUMINATI, at their discretion, will either:
  • Arrange for collection of the faulty product by a courier service, then once the product is back with LUMINATI  it will either be repaired or replaced with a comparable unit, or
  • A replacement product will be sent out and a courier service will be used to collect the faulty product.
  • All deliveries and collections will be at the cost of LUMINATI.
  • If the product is not packaged correctly no liability will be taken by LUMINATI if the product is damaged during transit.
  • If the product is returned in full working order no liability will be taken by LUMINATI and any costs incurred will be passed on to the customer.
  • For on-site service the product must be in a location accessible to our technician(s) and in no circumstances would LUMINATI staff be expected to remove screens or disassemble non-standard installations or constructions or be expected to work above ground level.
  • Where no genuine hardware failure has occurred a call out charge of at least £150 (+VAT) is payable for each visit.
  • For customised, bespoke or out of stock items the turnaround period is dependent upon factors such as, but not limited to, availability, production and shipping.
  • If a CMS licence is purchased with a product this is not transferable to any other products. If a product with a valid CMS licence suffers a hardware failure during its warranty period and a replacement product is required then LUMINATI will transfer the CMS licence in this case.

This warranty covers hardware failure and shall not apply to the following, including, but not limited to: damage which occurs in shipment; delivery or installation; integration into an enclosure or kiosk with insufficient air flow or ventilation; applications and uses for which this product was not intended; altered product or serial numbers; cosmetic damage or exterior finish; accidents, abuse, neglect, fire, water, lightning or other aspects of nature; use of products, equipment, systems, utilities, services, parts, supplies, accessories, applications, installations, repairs, external wiring or connectors not supplied or authorised by LUMINATI, or which damage this product or result in service problems; incorrect electrical voltage, fluctuations and surges; customer adjustments and failure to follow operating instructions, cleaning, maintenance and environmental instructions; product removal or reinstallation; reception or display problems and distortion related to noise, echo, interference or other signal transmission and delivery problems; reduced screen brightness related to normal aging, burned-in images, mura and defective pixels within the panel manufacturers accepted tolerance.

  • Covers hardware failure but excludes accidental damage or user error.
  • Free lifetime telephone and email technical support.

  • Any suspected hardware failure should be reported to LUMINATI first. LUMINATI will then provide telephone and/or email technical support to determine hardware failure; hardware failure must be confirmed by LUMINATI.
  • Once hardware failure has been determined by LUMINATI over the phone or on email replacement parts, along with an instructional guide, will be sent to the Client at the cost of LUMINATI. If the Client does not have the facility to repair the product then the product should be repackaged using the original packaging material and method (including bespoke pallet where necessary) and returned to LUMINATI at their cost. The product will then be repaired and sent back to the Client at the cost of LUMINATI.
  • In the event of advanced replacement parts being sent to the Client LUMINATI reserves the right to request faulty parts be returned to us at the cost of the Client after the repair work has been carried out. LUMINATI also reserves the right to request that faulty parts or products be returned to us for repair at the cost of the Client in the event that advanced replacement parts are unable to be sent.
  • If the product is not packaged correctly no liability will be taken by LUMINATI if the product is damaged during transit.
  • If the product is returned in full working order no liability will be taken by LUMINATI and any costs incurred will be passed on to the customer.
  • For customised, bespoke or out of stock items the turnaround period is dependent upon factors such as, but not limited to, availability, production and shipping.
  • If a CMS licence is purchased with a product this is not transferable to any other products. If a product with a valid CMS licence suffers a hardware failure during its warranty period and a replacement product is required then LUMINATI will transfer the CMS licence in this case.

  • All standard product ranges come with a 3 year warranty starting from date of invoice. This excludes all products purchased before 18/01/2016, which came with a 1 year warranty period.
  • Any suspected hardware failure should be reported to LUMINATI first. LUMINATI will then provide telephone and/or email technical support to determine hardware failure; hardware failure must be confirmed by LUMINATI.
  • Once hardware failure has been determined by LUMINATI over the phone or on email replacement parts, along with an instructional guide, will be sent to the Client at the cost of LUMINATI. If the Client does not have the facility to repair the product then the product should be repackaged using the original packaging material and method (including bespoke pallet where necessary) and returned to LUMINATI at their cost. The return address will be dictated by LUMINATI. The product will then be repaired and sent back to the Client at the cost of the Client.
  • In the event of advanced replacement parts being sent to the Client LUMINATI reserves the right to request faulty parts be returned to us at the cost of the Client after the repair work has been carried out. LUMINATI also reserves the right to request that faulty parts or products be returned to us for repair at the cost of the Client in the event that advanced replacement parts are unable to be sent.
  • If the product is not packaged correctly no liability will be taken by LUMINATI if the product is damaged during transit.
  • If the product is returned in full working order no liability will be taken by LUMINATI and any costs incurred will be passed on to the customer.
  • For customised, bespoke or out of stock items the turnaround period is dependent upon factors such as, but not limited to, availability, production and shipping.
  • If a CMS licence is purchased with a product this is not transferable to any other products. If a product with a valid CMS licence suffers a hardware failure during its warranty period and a replacement product is required then LUMINATI will transfer the CMS licence in this case.

This warranty covers hardware failure and shall not apply to the following, including, but not limited to: damage which occurs in shipment; delivery or installation; integration into an enclosure or kiosk with insufficient air flow or ventilation; applications and uses for which this product was not intended; altered product or serial numbers; cosmetic damage or exterior finish; accidents, abuse, neglect, fire, water, lightning or other aspects of nature; use of products, equipment, systems, utilities, services, parts, supplies, accessories, applications, installations, repairs, external wiring or connectors not supplied or authorized by LUMINATI, or which damage this product or result in service problems; incorrect electrical voltage, fluctuations and surges; customer adjustments and failure to follow operating instructions, cleaning, maintenance and environmental instructions; product removal or reinstallation; reception or display problems and distortion related to noise, echo, interference or other signal transmission and delivery problems; reduced screen brightness related to normal aging, burned-in images, mura and defective pixels within the panel manufacturers accepted tolerance.

Delivery

LUMINATI uses third party couriers to arrange and carry out deliveries and collections. LUMINATI  does not accept the responsibility, and will not offer any compensation, for any loss of profits caused due to the late delivery of any items by the courier. This is includes, but is not exclusive of, a project being delayed, missed organised installation time or date or any other inconvenience caused to the customer. LUMINATI will share any relevant contact information including, but not limited to, name, phone number, email address, geographical address and facsimile number with the third party courier we use for delivery of goods.

Upon delivery of any items the products must be fully checked and tested before being signed for. In cases where this is not possible the customer must sign for as “unchecked”. If there is any damage to the packaging the customer must sign for as “damaged”. All goods must be checked and tested to ensure they are in full working condition within 24 hours of receiving the goods with no exceptions. If there are any problems this must be reported to LUMINATI within 24 hours of receiving the goods. If this procedure is not followed LUMINATI are unable to claim compensation from the courier and will therefore not pay out on, or replace, damaged goods. It is the responsibility of LUMINATI ‘S customers to pass this information on to their end users should the goods be shipped directly to them.

Exclusions and Limitations

The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, this Company:

  • excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature; and
  • excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
  • If you are returning your purchase the product must be complete and in ‘as new’ condition. If you have opened the box to examine the product you must have done so without damaging or marking the product or packaging. It should be returned with the original box and packaging, along with any accessories you received with it. If you follow the above, we will issue you with a full refund for the cost of the product.

The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
